Terms of service

This is the agreement between you and e2w consulting llc for e2w drive. It is written to be read, not to be survived. If a sentence in it is unclear, that is our fault and we would like to hear about it.

The short version

Your files stay yours. We store them and give them back. We never open them, and we never send them to an AI model.
e2w drive is an early release. It works, and it is not finished. Keep another copy of anything you cannot afford to lose.
The free trial is 3 GB, one per person. When it is full, backing up stops and nothing is deleted. Leave it full for two months and the drive is removed from our systems — we tell you first, and the copies on your own computers are never touched.
You can leave whenever you like. Closing your account is free, is not buried, and erases everything.
If we ever end it from our side, your files come out first. You are told, and you get a way to download everything, before anything is removed.

1Who this agreement is with

e2w drive is operated by e2w consulting llc. In these terms, we, us and our mean e2w consulting llc, and you mean the person or the company that holds the account.

You accept these terms by creating an e2w drive account or by using e2w drive. If you are doing that on behalf of a company, you are confirming that you are allowed to commit that company, and these terms bind it.

The privacy notice forms part of this agreement. It says exactly what we hold about you, where it is kept and how to get rid of it. If anything here and anything there ever disagree, the privacy notice wins — the stricter promise is the one we intend to keep.

2What e2w drive is

e2w drive backs up folders you already work in, where they already are. Files are not moved into a special folder to be protected: you point e2w drive at the folders that matter, and it copies what is in them to European storage as they change.

There is a Windows app that does the backing up, and a web app for getting at your files from anywhere. The contents of your files are stored in the Netherlands; your account and file list are stored in the United Kingdom. The privacy notice sets that out in full.

3e2w drive is an early release

Read this one even if you skip the rest.

e2w drive is published as an early release. It is a working product that real people are backing up real files with, and it is also young. While it is an early release:

Features will change, and some will change in ways that are not backwards compatible. We will tell you before anything you rely on goes.
There is no uptime commitment and no service level agreement. We may need to take e2w drive offline to fix or upgrade it, sometimes at short notice.
There is no guaranteed support response time. We do answer, and we answer quickly, but that is a habit rather than a promise you can enforce.
Things can break. When they do we will say so plainly rather than quietly.

So: keep at least one other copy of anything you cannot afford to lose. We would rather say that and lose the sale than let a customer make e2w drive the only place a file exists at this stage. When e2w drive is out of early release we will publish terms that carry real commitments, and we will tell you when that happens.

4Your account

You must be 16 or over to have an e2w drive account.
Use an email address you actually control, and keep your details accurate. The address is how we reach you about your own data, so a dead one is a real problem.
Your password is yours to keep. We store it only as a hash: nobody at e2w can see it, and we cannot recover it — only reset it.
You are responsible for what happens under your account, including what the people you invite to your drive do with it. Inviting somebody gives them real access to real files.
One account is for one person. Sharing sign-in details is the most common way an account is taken over. Add a colleague to your drive instead — that is what the People tab is for.

If you think somebody else has got into your account, tell us. You do not have to wait for us: you can cut off any connected computer yourself, immediately, and that machine stops syncing at once.

5The free trial

The free trial is a demonstration of e2w drive, not a permanent free plan. It gives you:

3 GB of European storage, with no card and no sales call.
A daily upload allowance of about 15% of your storage allowance — roughly 460 MB a day on 3 GB. This stops a first install of a large folder swallowing the whole trial in an afternoon and leaving you with a drive that is full before you have decided anything.
One free trial per person. To hold that open we keep a one-way code made from your email address even after an account is closed. It cannot be turned back into an address. This is described in the privacy notice, and you can ask us to remove it.

When the 3 GB is full, backing up stops. Nothing is deleted at that point. Everything you have already backed up stays where it is, stays in your file list, and stays downloadable. New and changed files simply stop being copied up until you upgrade or make room, and both the app and the web app say so rather than failing quietly.

A drive that stays full for two months is removed from our systems. The two months run from the day the drive fills, and they stop the moment you upgrade or make room. Before the drive is removed we will email you and give you a way to download everything in one go.

The copies on your own computers are never touched. e2w drive is a backup of files that live on your machines, and removing a drive from our systems does not reach on to them. Nothing we do, at any point, deletes a file on a computer of yours — but a backup you have let lapse is not a backup, so if the files matter, keep the drive current or keep another copy.

We may put a time limit on the trial as well as a size limit. If we do, we will email you before it starts to apply to your account, and you will have a fair period to upgrade or to take your files out. We will not shorten a trial you are already in without telling you first.

Trials are for trying e2w drive. Creating extra accounts to get around the trial limits — new addresses, disposable domains, one account per folder — is not allowed, and those accounts can be closed without notice.

6Your files are yours

You keep every right you have in everything you put into e2w drive. We claim nothing in it.

To run the service we need your permission to do a very short list of things with your files, and this is that list in full: store them, copy them between your computers and our storage, keep the versions and deleted-file copies the product offers, and send them back to you or to somebody you have shared them with. That permission lasts while your account does and ends when your files are deleted.

We never open your files. Nothing in e2w drive reads inside a file — not to index it, not to scan it, not to make a preview.
Nothing is sent to an AI model. We do not run one. The drive summary e2w drive can produce is made on your own computer from file names, sizes and dates, and it is handed to you to paste into whichever assistant you already use.
Nothing you store is used to train anything, ours or anybody else's.
We do not sell, rent or trade your data, and there is no advertising anywhere in e2w drive.

You are responsible for having the right to store and share what you put in. If a file is not yours to copy, e2w drive is not the place to put it.

7What you must not do

Short list, and none of it will surprise you. Do not use e2w drive to:

Store or share anything illegal where you are or where our servers are — and specifically never material that sexually exploits children.
Store or distribute malware, or use e2w drive as the delivery point for an attack on somebody else.
Infringe somebody else's copyright, trade marks or other rights.
Resell e2w drive, or run somebody else's storage service on top of your account, without a written agreement with us.
Attack the service — break into other accounts, get round quotas, rate limits or the trial, or deliberately load the system to the point where it stops working for other people.
Take e2w drive apart to build a copy of it, or work around the technical limits in the app.

Automated access is fine within reason: the Windows app is doing exactly that. What is not fine is traffic designed to cost us more than a customer could ever pay.

8Sharing files

e2w drive lets you share a file by link or with a named person, put a password on a share, give it an expiry date, cap how many times it can be downloaded, and withdraw it afterwards.

A share link is a key. Anyone who has it can use it, within whatever limits you set, so send it the way you would send a key. If a link gets out, revoke it — that takes effect immediately.

What you share, and who you share it with, is your decision and your responsibility. We do not look at shared files and we do not police them, but we will act on a credible report that something in section 7 is being shared.

9Paying for e2w drive

There is nothing to pay today, and there is no card on file. When paid plans start:

Prices, what each plan includes and how billing works will be published before anybody is charged.
You will never be moved onto a paid plan without choosing it. A trial that quietly becomes a subscription is not something we will do.
Card details will be handled by a payment provider and will not reach our systems.
If we change the price of a plan you are on, we will tell you by email before it applies to you, and you will be able to leave rather than accept it.

If a payment fails we will tell you and give you a fair chance to fix it before anything about your drive changes. We will not delete your files for non-payment. A drive that is not paid for stops accepting new backups, and your files stay available to download while we sort it out.

10Ending it

You, at any time

You can close your account whenever you like. It is free, it is not buried behind a phone call, and we do not ask you why. When you do, your files are deleted from storage and your account details, file list, sharing history, device list and activity log go with them. One one-way code survives, and only that; the privacy notice explains it and tells you how to have it removed too.

Before you close the account, download anything you want to keep. Once it is deleted we cannot bring it back — that is the point of deleting it.

Us, if we have to

We may suspend or close an account that is doing something in section 7, or where we are required to by law. We may also stop offering e2w drive altogether.

In every one of those cases except illegal content, you get your files out first. We will tell you, give you a reasonable period to download everything, and only then close the account. We will not delete a backup at short notice, and we will not hold your files hostage over a dispute.

11When something goes wrong

e2w drive is provided as it is. While it is an early release we cannot promise it will always be available, always be fast, or never lose data, and it would be dishonest to write a clause here saying otherwise.

What we do promise is the behaviour around a failure: we will tell you what happened, we will not pretend it did not, and we will not quietly change this page afterwards.

Except where the law does not allow it to be limited — and it does not allow anyone to exclude liability for death, personal injury, fraud, or their own gross negligence — we are not liable for lost profits, lost business, or losses that could not reasonably have been expected, and our total liability to you for anything connected with e2w drive is limited to what you have paid us in the twelve months before the problem arose. While you are on a free trial that figure is zero, which is precisely why section 3 asks you to keep another copy.

Nothing here takes away the rights you have as a consumer under the law of the country you live in.

12Changes to these terms

If we change anything here that matters to you, we will email you before it takes effect rather than quietly updating the page and hoping. The version number and date at the top always tell you which terms are in force, and if you do not want to accept a change you can close your account and take your files with you.

13Law and disputes

These terms are governed by the law of GOVERNING LAW REQUIRED, and the courts there have jurisdiction over any dispute — except that, if you are a consumer, you keep the right to bring a claim in the courts of the country where you live, and the protections of that country's consumer law still apply to you.

Please come to us first. Almost everything is a misunderstanding we can fix the same day, and we would much rather fix it than argue about it.

14Odds and ends

These terms, plus the privacy notice, are the whole agreement between us about e2w drive.
If a court decides one part of this is unenforceable, the rest still stands.
If we do not enforce something straight away, we have not given up the right to enforce it later.
You may not transfer your account to somebody else without asking us. We may transfer this agreement to another company in the e2w group, and we will tell you if we do.
